Assume that Sherrie's Cherries contracts with Dessert World to sell and ship 600 pounds of cherries in three equal installments of 200 pounds each. If the first installment arrives with 5 pounds of spoilage, then Dessert World may:
a.
reject the installment shipment because of the perfect tender rule.
b.
not reject the installment if those in the food industry expect a small percentage of spoilage with fresh fruits or vegetables.
c.
reject the entire contract.
d.
declare a breach and "cover."

Answers

If the first installment of 200 pounds of cherries arrives with 5 pounds of spoilage, Dessert World may not reject the installment if those in the food industry expect a small percentage of spoilage with fresh fruits or vegetables.

This is because of the implied warranty of merchantability, which applies to the sale of goods. The implied warranty of merchantability guarantees that goods being sold are fit for their ordinary purpose, free from defects, and of at least average quality.

In the food industry, it is common knowledge that a small percentage of spoilage can be expected in fresh fruits or vegetables. This is known as the "industry standard," which is a recognized level of quality and performance commonly accepted in a particular industry.

Therefore, if the spoilage is within the industry standard, then Dessert World cannot reject the installment based on the perfect tender rule, which requires that the goods be delivered exactly as specified in the contract. However, if the spoilage exceeds the industry standard or makes the cherries unusable, Dessert World may reject the installment, declare a breach, and cover.

The sentence "“Coach wants me to organize the team dinner,” said Derrick." is capitalized correctly. So the option D is correct.

There aren't many capitalization rules. These are simple to recall. In English, proper nouns, the pronoun I, and the beginning of sentences are the places where capital letters are most frequently employed.

No matter what the term is, the initial letter of the first word in a sentence should always be capitalised. Consider the following phrases as an example: The sky was stunning. The day was sunny.

The terms the and it are capitalized here even though they aren't proper nouns because they come first in their phrases. Even these typically lowercase words are capitalized at the beginning of sentences unless otherwise specified by a style manual.

In my school, dress code is a common enemy. The girls are treated unfairly and must abide by the rules while the boys get off free.

Explanation:

Dear Mr/Ms……,

It was brought to my attention that there is some inequity in the school’s enforcement of the uniform policy.  Many times the girls have been told their shorts are too short while we have personally observed several boys walking around with their pants so low that their underwear can be seen.  Many of us believe this is wrong and is an indication of disparate treatment.

We have always been raised that a rule is the expectation, regardless.  If the boys are allowed to interpret the rule any way that they can, the girls should be able to as well.  We understand the schools thought process that shorter shorts or tank tops can distract the boys, but we find that unacceptable.  To us that is simply allowing their behavior to continue and simply saying “boys will be boys”.  Women have fought in the last 100 years for equality and the “boys will be boys” philosophy should not be accepted.

However, we recognize sometimes there are more issues and life is not as simple as we wish it could be.  Therefore, we are not asking to change the dress policy to allow girls to wear tank tops or be questioned when their shorts are 4/10th of an inch too short, we are simply asking that the rules be enforced with equity, that everyone is held to the same expectation because we are all equal.

We have been told that a good negotiation is when no one walks away from the table happy because no one person got what they absolutely wanted.  We believe, if you want to treat the girls and boys with equality, then the rules should be enforced with equality.  If the expectation is clearly communicated to everyone and enforced with equality, then no one has any room to complain, even if they don’t agree with the policy.

We appreciate your time.

The sentence from chapter 11 of "The Awakening" by Kate Chopin, which states, "[Edna] tottered up the steps, clutching feebly at the post before passing into the house," is representative of Chopin's style primarily because of the words "tottered" and "clutching feebly" and their strong connotative meanings.

How to explain the information

Chopin's writing often incorporates vivid and evocative language to convey emotional states and inner experiences. In this sentence, the word "tottered" suggests unsteady and wavering movement, conveying a sense of physical and emotional instability. Similarly, "clutching feebly" implies a weak and desperate attempt to hold on to something, underscoring Edna's vulnerability.

Chopin's focus on the characters' inner lives and emotional experiences is a key aspect of her writing style. By employing words with strong connotations like "tottered" and "clutching feebly," she creates a vivid portrayal of Edna's fragile state and the intensity of her inner turmoil.
